Please read these terms and conditions carefully before using any of our mobile applications (the "App" or "Apps") published and operated by App Lane/Dominik Maglia ("us", "we", or "our").

Using Our App

By downloading or using the App, these terms will automatically apply to you.

You must be at least 13 years of age to use this App. If you are not of legal age, you affirm you have consent from a parent or guardian to use the App and accept these terms on their behalf.

Account Registration

You may need to register an account ("User Account") to fully use our services. You agree to keep your password confidential and are responsible for all use and activity on your account. We reserve the right to remove or reclaim any usernames at any time and for any reason, including claims by a third party that a username violates their rights. Your User Account is created and hosted with App All Day Pty Ltd. which is subject to their terms and conditions.

Paid Features and Subscriptions

The App may include paid features and subscriptions. All fees and charges will be disclosed to you prior to purchase.

Auto-renewal is enabled by default when you subscribe and your subscription will renew automatically at the end of each subscription period unless auto-renewal is turned off at least 24 hours before the period ends.

Your account will be charged prior to the start of each subscription. You can cancel anytime to avoid future charges by turning off auto-renew at least 24 hours before the subscription is set to renew. No cancellation refunds are provided for unused subscription time.

We reserve the right to change the subscription terms, fees, or charges at any time with reasonable notice provided to you.

Downloads and Usage

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable license to download, install, and use one copy of the app on your personal smartphone, tablet, computer, or other device(s).

You may not share, publish, copy, adapt, sublicense, or otherwise distribute the App or its contents. Use of the App must be in accordance with applicable third-party terms (i.e. your app store terms). You must comply with all applicable laws when using or accessing the App.

We reserve the right to modify, suspend, or discontinue the App at any time and for any reason without notice. We will not be liable to you for any damages related to changes to the App or its discontinuation.

User Content

The App may allow you to create, submit, post, display, transmit or exchange content, including text, images, designs, opinions or other content ("User Content"). You are solely responsible for any User Content you create, submit, post, display, transmit, or exchange.

You agree that you will not contribute any User Content that is defamatory, abusive, hateful, threatening, spam, in violation of copyright or trademark laws, or is otherwise objectionable or prohibited by these terms.

We do not claim ownership over your User Content. However, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, copy, modify, distribute, publish, perform, sublicense, and create derivative works from all User Content you contribute to the App, in any form, media, software or technology of any kind now known or developed in the future.

You warrant that you have all rights necessary to contribute the User Content and that it does not violate any copyright, trademark, privacy, publicity, or other right of any party. You further agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country you reside in.

Intellectual Property Rights

All content included in or made available through the App, including designs, text, graphics, images, interfaces, icons, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and software (the “App Content”), and the compilation and arrangement thereof, are the exclusive property of App Lane/Dominik Maglia and its licensors.

The App and App Content are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You must not copy, download, modify, create derivative works of, publicly display or distribute any App Content except as expressly authorized by us or applicable third-party licensors.

Doing so violates copyright and other intellectual property laws. You must not remove or alter any copyright, trademark, or other proprietary notices contained in the App or App Content.

Third-Party Content

The App may contain links to or integrations with third-party websites, apps, products, or services. We are not affiliated with and do not endorse or control those third parties.

Third-party content is governed by the terms and conditions of the applicable third party. We have no responsibility for third-party content and we expressly disclaim any liability arising from your use of or reliance on any third-party content.

In-App Purchases

The App may enable you to purchase access to premium content or services (“In-App Purchases”). All In-App Purchases are subject to these terms and any additional terms made available when you make the purchase.

We reserve the right to change, modify, or discontinue In-App Purchases at any time. Any unused In-App Purchases are not transferable or redeemable for cash. We do not provide refunds for any In-App Purchases unless required by law.

Push Notifications

With your consent, the App may send push notifications or alerts to your mobile device to provide information about new content available or other updates. You can disable this feature at any time through your device notification settings.

Disclaimers

The App and any content or services provided therein are provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including the warranties of merchantability, fitness for a particular purpose, non-infringement, and title.
The App may contain bugs, errors, problems, or other limitations. We will not be held responsible for any interruptions or issues arising from the use of the app or its content or services.

Limitation of Liability

In no event shall App Lane/Dominik Maglia be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use or inability to use the app or its content or services.
In no case shall our total liability arising from your use of the app or its content or services exceed the amount you paid to us for the use of the app or its content or services.

Indemnification

You agree to defend, indemnify and hold us harmless from and against any third-party claims, damages, or costs related to: your use of the App; your violation of these terms; your violation of any third-party rights or applicable laws, rules, or regulations.

Governing Law

These terms will be governed by the laws of Switzerland. You hereby consent and submit to the exclusive jurisdiction of the state and federal courts located in Switzerland for any disputes related to your use of the App or these terms.

Changes to These Terms

We may update these terms at any time. We will notify you of material changes via the App store notifications or via an in-app message. You should periodically review these terms to stay informed of any updates. Your continued use of the App constitutes acceptance of the amended terms.
