Terms & Conditions

These Terms & Conditions ("Terms") constitute a legal agreement between you and App Lane OÜ ("we," "us," "our," or "Company") regarding your use of our mobile applications and services.

These Terms apply to all applications developed and published by us, including but not limited to HRM Heart Rate Monitor and Mowbius. By downloading, installing, or using any of our applications, you agree to be bound by these Terms.

Using Our Apps

You must be at least 13 years of age to use our applications. If you are not of legal age, you affirm you have consent from a parent or guardian to use the App and accept these Terms on their behalf.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to download, install, and use one copy of our applications on your personal devices.

You may not share, publish, copy, adapt, sublicense, or otherwise distribute our applications or their contents. You must comply with all applicable laws when using our applications.

Paid Features and Subscriptions

Our applications may include paid features and subscriptions. All fees and charges will be disclosed to you prior to purchase.

Auto-renewal is enabled by default when you subscribe and your subscription will renew automatically at the end of each subscription period unless auto-renewal is turned off at least 24 hours before the period ends.

Your account will be charged prior to the start of each subscription. You can cancel anytime to avoid future charges by turning off auto-renew at least 24 hours before the subscription is set to renew. No cancellation refunds are provided for unused subscription time.

Service Availability

We work hard to keep our apps and services running smoothly, but we can't guarantee they'll be available 100% of the time. Our services may occasionally be interrupted for maintenance, updates, or due to technical issues beyond our control.

We provide our services on a "best effort" basis and aren't responsible for any downtime or service interruptions that might affect your use of our apps.

Data Loss Protection

While we take measures to protect your data, we strongly recommend that you regularly back up any important information stored in our apps. We cannot guarantee against data loss due to technical issues, device problems, or other unforeseen circumstances.

You're responsible for maintaining your own backups of any content or data you consider important. We're not liable for any lost data, even if it results from issues with our syncing services.

Third-Party Services

Our apps may integrate with or rely on third-party services (like app stores, payment processors, or cloud storage providers). These services have their own terms and policies that also apply to your use of our apps.

We're not responsible for any issues, changes, or problems with these third-party services. If a third-party service becomes unavailable or changes its terms, it might affect how our apps work.

Termination Rights

We reserve the right to suspend or terminate your access to our apps and services if you violate these Terms or engage in behavior that we believe is harmful to other users or our business.

You can stop using our apps anytime by deleting them from your devices. If you have an account with us, you can also request account deletion by contacting us.

When access is terminated (by either party), these Terms will still apply to any past use of our services, and certain sections (like intellectual property and liability limitations) will continue to apply.

Your Content and Responsibilities

Our applications may allow you to create, submit, post, display, transmit or exchange content. You are solely responsible for any content you create or share.

You agree that you will not contribute any content that is defamatory, abusive, hateful, threatening, spam, in violation of copyright or trademark laws, or is otherwise objectionable or prohibited by these Terms.

Intellectual Property Rights

All content included in or made available through our applications is the exclusive property of App Lane OÜ and its licensors.

Our applications and their content are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You must not copy, download, modify, create derivative works of, publicly display or distribute any content except as expressly authorized by us or applicable third-party licensors.

Important Disclaimers

We provide our apps "as is" and work hard to make them reliable, but we can't guarantee they'll always be perfect or error-free. We don't make any warranties about our apps beyond what's required by law.

Limitation of Liability

In no event shall App Lane OÜ be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use or inability to use the app or its content or services.

Indemnification

You agree to defend, indemnify, and hold harmless App Lane OÜ and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our applications.

Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

App-Specific Terms

HRM Heart Rate Monitor

The following additional terms apply specifically to the HRM Heart Rate Monitor application:

Health and Medical Disclaimer

HRM Heart Rate Monitor is intended for general fitness and wellness purposes only and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The heart rate measurements and health-related information provided by the application should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Always consult with a qualified healthcare professional before making any decisions related to your health. The application's measurements may not be completely accurate and should not be relied upon for medical purposes or emergency situations.

You acknowledge that you use the health monitoring features at your own risk and that App Lane OÜ is not responsible for any health-related decisions you make based on the application's data.

Mowbius

The following additional terms apply specifically to the Mowbius application:

Account Registration

Mowbius requires account registration to access certain features. You agree to keep your password confidential and are responsible for all use and activity on your account. We reserve the right to remove or reclaim any usernames at any time and for any reason. Your account is created and hosted with App All Day Pty Ltd. which is subject to their terms and conditions.

Data Synchronization

When you create an account in Mowbius, certain application data may be synchronized across your devices. This synchronization is designed to improve your user experience but requires an active internet connection. We are not responsible for any data loss that may occur during synchronization processes.

You may disable data synchronization at any time through the application settings, though this may limit certain features.

Governing Law

These Terms will be governed by the laws of Zurich, Switzerland. You hereby consent and submit to the exclusive jurisdiction of the state and federal courts located in Switzerland for any disputes related to your use of our applications or these Terms.
