Using Our App

By downloading or using the App, these terms will automatically apply to you.

You must be at least 13 years of age to use this App. If you are not of legal age, you affirm you have consent from a parent or guardian to use the App and accept these terms on their behalf.

Account Registration

You may need to register an account ("User Account") to fully use our services. You agree to keep your password confidential and are responsible for all use and activity on your account. We reserve the right to remove or reclaim any usernames at any time and for any reason, including claims by a third party that a username violates their rights. Your User Account is created and hosted with App All Day Pty Ltd. which is subject to their terms and conditions.

Paid Features and Subscriptions

The App may include paid features and subscriptions. All fees and charges will be disclosed to you prior to purchase.

Auto-renewal is enabled by default when you subscribe and your subscription will renew automatically at the end of each subscription period unless auto-renewal is turned off at least 24 hours before the period ends.

Your account will be charged prior to the start of each subscription. You can cancel anytime to avoid future charges by turning off auto-renew at least 24 hours before the subscription is set to renew. No cancellation refunds are provided for unused subscription time.

Downloads and Usage

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable license to download, install, and use one copy of the app on your personal smartphone, tablet, computer, or other device(s).

You may not share, publish, copy, adapt, sublicense, or otherwise distribute the App or its contents. Use of the App must be in accordance with applicable third-party terms (i.e. your app store terms). You must comply with all applicable laws when using or accessing the App.

User Content

The App may allow you to create, submit, post, display, transmit or exchange content. You are solely responsible for any User Content you create, submit, post, display, transmit, or exchange.

You agree that you will not contribute any User Content that is defamatory, abusive, hateful, threatening, spam, in violation of copyright or trademark laws, or is otherwise objectionable or prohibited by these terms.

Intellectual Property Rights

All content included in or made available through the App is the exclusive property of App Lane OÜ / Dominik Maglia and its licensors.

The App and App Content are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You must not copy, download, modify, create derivative works of, publicly display or distribute any App Content except as expressly authorized by us or applicable third-party licensors.

Disclaimers

The App and any content or services provided therein are provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including the warranties of merchantability, fitness for a particular purpose, non-infringement, and title.

Limitation of Liability

In no event shall App Lane OÜ / Dominik Maglia be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use or inability to use the app or its content or services.

Indemnification

You agree to defend, indemnify, and hold harmless App Lane/Dominik Maglia and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App, including, but not limited to, your User Content, any use of the App's content, services, and products other than as expressly authorized in these Terms.

Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Governing Law

These terms will be governed by the laws of Zurich, Switzerland. You hereby consent and submit to the exclusive jurisdiction of the state and federal courts located in Switzerland for any disputes related to your use of the App or these terms.
